8/15/03 BREACH OF CONTRACT BARTON, VS FB. HOWARD CO. DISMISSED W/P 3/26/04 (case number- 03CV177019-01) (My short annalysis, The Bartons insured with farm Bureau and lost their home to a fire on 5/1/03. On 5/14/03 the Bartons delivered a proof of loss to Farm Bureau for the house and contents. On 5/29/03 farm Bureau returned the proof of loss claiming it was incomplete or deficient. On 5/30/03 the Bartons returned the proof of loss to Farm Bureau explaining all their records were lost in the fire and that was the best they could provide. On 6/16/03 The Bartons hired an attorney who made demand to Farm Bureau that they pay the claim. On 6/18/03 Farm Bureau had already retained their law firm Brown and James who through Robert Brady starts the same old delay tactics they use so often, and so successfully. Robert Brady's letter is available on the other fb lawsuits barton page. This letter is a good example of Farm Bureaus willingness to unfairly use minor technical aspects of the policy language to delay and deny the claim. The list of documents Farm Bureau demanded the Bartons provide is also a good example of how "Farm Bureau does not treat each and every client as if they were their only one" as they state in their advertizing. On 8/4/03 Farm Bureau filed and answer to the Bartons Petition which is a mirror image of the letter by Bob Brady, no substance, just intimidation, confusion, and delay. Farm Bureaus usual tactics. On 3/25/04, ten months after the fire the Bartons accept settlement. It appears that by the Bartons retaining an attorney early they did not suffer four or five years of Farm Bureaus typical delay tactics. However, I do not know how much less Farm Bureau forced them to settle for than they deserved.)

8/27/03 PROPERTY DAMAGE FB. VS WESTLAKE, BOONE CO. DEFAULT 3/2/04 03CV167912 (My short analysis, Virgil Koch insured with Farm Bureau. On 10/3/2001 Westlake pulled out in front of Koch causing damage of $2,868.65 to Kochs car. In this case Farm Bureau paid the claim to Koch before 8/27/2003. Looks like Farm Bureau may have delayed paying Koch for a year and ten months. Then on 3/2/2004, seven months later filed suit against Westlake who caused the wreck to recoup the loss paid to their insured.)

Farm Bureau appeals and Blakeman, desperate after 3 years delay, and facing 2 more in Farm Bureaus appeal accepts Farm Bureaus settlement offer.)

1/13/04 DECLARATORY JUDGMENT FB. V BOOSE, CLAY CO. DISMISSED WO/P 4/26/06 7CV104000303 (My short analysis, Richard Boose insured with Farm Bureau and suffered a tornado loss to his home on 5/4/2003. Two months later on 7/14/2003 Boose filed a proof of loss for $267,475.00 to Farm Bureau. On 1/13/2004 after delaying for six months, Farm Bureau filed this Declatory Judgment suit denying the claim. Farm Bureau used the exact accusations, word for word, on Boose that they used on us. At this same time Farm Bureau ask the court to delay serving the summons to Boose. "was this suit being used as a pressure tactic to force a low settlement on Boose?." No further action was presented on the suit. The Judge dismissed the suit on 4/26/06. No reference to what Farm Bureau forced Boose to settle for.)

(My short analysis, the Friedleys suffered a fire loss on 7/22/02 Which Farm Bureau paid. Then had a second fire on 10/19/02, for which Farm Bureau denied payment. On 2/4/04 farm Bureau filed a declaratory judgment suit against friedley. Case was then settled on 8/3/04. With-out more information I have no more on this case.)
3/20/04 DECLARATORY JUDGMENT FB. V MURPHY, JACKSON CO. DISMISSED W/P 1/6/06 04CV208515 (My short analysis, on 6/9/2003 Murphy bought an insurance policy from Farm Bureau. A fire occured on 6/25/2003. Murphy filed a claim with Farm Bureau on 9/2/2003 for $213,336.49. On 3/20/2004, six months later, Farm Bureau filed suit against Murphy denying coverage because of Concealment, Fraud, or Misrepresentations in their application. Farm Bureaus lawyers on 1/18/05 after delaying another ten months files a deposition notice to depose Murphy. After four more months delay on 5/27/05 Farm Bureau files for an additional three months delay. Six months later on 1/6/2006 Farm Bureau files for a dismissal with Murphy. Nothing in public record refering to settlement terms or amounts. This is yet another example of Farm Bureau denying a claim, delaying payment of claim for years, sueing the insured, then dismissing the suit with-out going to court and proving their accusations)
4/9/04 BREACH OF CONTRACT SUMMERS, V FB. CHRISTIAN CO. DISMISSED 12/3/04 04CT-CV00354 (My short analysis, Janet Summers was insured with Farm Bureau and suffered a fire loss on Oct. 9, 2003. Farm Bureau paid the bank the amount Summers owed them, But refused to pay summers the rest of the claim. On April 9, 2004 Summers filed suit to force Farm Bureau to pay her part of the claim. Farm Bureau claimed they had canceled the policy before the fire. So why would they pay the bank and not Summers. Could it be Bob Brady and Brown and James saw a claim that could be delayed and denied, forcing a lower settlement for Farm Bureau to pay. If I find any settlement documents I will post them on this page. I could be wrong in my assumption, if so I will post a correction.)

(My short analysis, Rardons had a water and mold damage loss on 5/11/03. They submitted a proof of loss to Farm Bureau on 9/22/03. Farm Bureau denied payment and delayed claim until 5/17/04 when Rardons filed suit to force Farm Bureau to honor claim. On 7/15/04 Farm Bureau sued Rardons for declaratory judgment, which is asking the court to declare the policy void. Farm Bureau delayed claim until 5/25/06 when Rardons accepted Farm Bureaus settlement.) (Eugene Parton stated in open court on 2/20/07 while testifying in my case that Farm Bureau had secretely tape recorded Rardon during the investigation of his claim.) 5/18/04 BREACH OF CONTRACT FRISBIE, V FB. (My short analysis, Kevin Frisbie insured with Farm Bureau, his house burned on 4/15/03. After over a year of Farm Bureau's delaying tactics Frisbie filed suit to force them to pay. Here comes Brown and James' Robert Brady following "the books directions" with denials and accusations against the policyholder. Leading to the inevitable forced settlement at a great savings to Farm Bureau. And of course a tidy fee for Brown and James at the cost of the policyholder.)
6/14/04 DECLARATORY JUDGMENT FB.V DALTON, ST. FRANCOIS CO. NOT DISPOSED 04CV612899 (My short analysis, The Daltons house and contents were destroyed in a fire on 12/15/2003. The Daltons filed a claim for $115,000.00. Farm Bureau denied as usual and on 6/14/2004 sued the Daltons for their usual thing, concealment, fraud, misrepresentaion, and for inflating their losses. On 8/13/2004 the Daltons countersued Farm Bureau for Breach of contract.)

10/12/04 BREACH OF CONTRACT WIMBERLY, V FB. LAFAYETTE CO. DISMISSED 10/20/05 04LF-CV00820 (My short analysis, The Wimberlys suffered water damage loss on 2/3/04. Farm Bureau in concert with Robert Brady and Brown and James, denied coverage. After eight months delay the Wimberlys sued on 10/12/04. In Farm Bureaus answer they claimed because the water leaked from pipes under the house, then traveled through the earth before entering the house Farm Bureau was not liable. After one more year of delay the Wimberlys accepted Farm Bureaus settlement offer and the case never went to trial. Once again Farm Bureau did not have to prove their case. And I have found no public records of the settlement amount.)

1/24/05 BREACH OF CONTRACT DRIVER, V FB. CHRISTIAN CO. DISMISSED W/P 1/31/06 05CT-CV00085 (My short analysis, Lynn Driver insured with Farm Bureau and had a fire loss on May 17, 2003. Drivers Farm Bureau agent, Kevin Cheffey mistakenly under insured Drivers property. Farm Bureau refused to correct agent Cheffeys mistaken calculations on the value of Drivers home. On Jan. 24, 2005 after over two years of delay Driver sues Farm Bureau to force payment of the claim. On March 4, 2005 Farm Bureau answers Drivers suit. On Jan. 31, 2006 another Farm Bureau policy holder is forced to settle after nearly three years of delay.) 2/25/05 OTHER ACTIONS CHARLEY, V FB PLATTE CO 05AE-CV00606 (My short analysis, the Charleys were under insured at the direction of Farm Bureau agent Chad Wright in 1997. On June 29, 2001 when their home was destroyed by fire the amount of under insurence was discovered. Farm Bureau paid part of the claim but refused to correct the under insurance amount. Farm Bureau adjuster Debra Griffin misled the Charleys about debris removal cost. Farm Bureau denied any further payment to the Charleys who brought this suit to collect payment of their claim on Feb. 25, 2005.) 8/2/05 BREACH OF CONTRACT JBS PROP, V FB. JACKSON CO. DISMISSED W/P 5/15/06 0516-CV20743 (My short analysis, JBS Properties had a water damage loss on 4/14/2004. On 5/20/2004 Regency Restoration estimated repairs at $40,094.28. Farm Bureau paid half of Regency Restoration's estimate. In early July Farm Bureau presented JBS with a full and complete release to sign stating that the balance of the repair estimate would not be paid until it was signed. On 7/8/2004 JBS signed the release to get the final repairs finished and paid stipulating that rental loss would be due on completion of the repairs. Farm Bureau refused to pay the JBS claim and on 8/2/2005 JBS was forced to file suit against Farm Bureau To recover losses. Farm Bureaus delay of over a year in paying the claim resulted in JBS being forced to accept Farm Bureaus settlement. Farm Bureau knows these forced settlements save them from having to prove their unfair and trumped up accusations they use in their lawsuits. Farm Bureau and their Law Firm Brown and James know just how to manipulate the courts and policyholders to force these settlements. My analysis of Farm Bureau claims denied and lawsuits with policyholders shows that their accusations used in the lawsuits are never proven because I have yet to analylize one case where Farm Bureau won a suit. In fact I've only found one case that went to trial and they lost it.)
8/25/05 BREACH OF CONTRACT WEAVER, V FB. ST. CLAIR CO. DISMISSED 4/25/06 05SR-CC00045 (My short analysis, Rick Weaver was insured by Farm Bureau on 9/18/2003 when his home and contents were destroyed by fire. On 3/10/2004 Farm Bureau denied Weavers fire loss claim in the amount of $100,000.00. Two years later on 8/25/2005 Weaver filed this suit to force Farm Bureau to honor the policy. On 10/7/2005 Farm Bureau rolls out their giant law firm once again with their boxing gloves on. They once again accuse the policy holder of burning his own home, intentionally concealing facts, refusing to cooperate, refusing to provide documents, and for concealment, fraud and misrepresentation. If this case goes as the 167 other Farm Bureau cases with their members, none of these accusations will be proven in court. The policyholder will be forced by the long delay to accept Farm Bureaus low settlement offer.)
8/26/05 OTHER TORT FISK, V FB. JACKSON CO. DISMISSAL W/P 4/12/06 0516-CV23727 (My short analysis, Robert Fisk bought auto insurance from Farm Bureau and while driving it caught on fire and was destroyed. Farm Bureau delayed paying the claim for 15 months when Fisk sued to force Farm Bureau to pay Farm Bureau accused Fisk of burning his own truck and denied the claim. after the typical Farm Bureau tactic of long delays Fisk was forced to settle as so many are. I have found no case yet where Farm bureaus accusations against their policyholders held up in court. They make the accusation, then settle before having to prove it in court.)
10/19/05 PROPERTY DAMAGE YOUNG, V FB. CASS CO. DISMISSED 6/25/06 05CA-CV1686 (My short analysis, the Youngs insured their home and contents with Farm Bureau on 8/24/2004. They lost it all on 12/22/2004 and filed a claim with Farm Bureau for $371,000.00 which as usual was denied. After 18 months of Farm Bureau and Brown and James delays manipulated by Robert Brady and Eugene Parton the Youngs settled for an undisclosed amount.)
6/26/06 CONTRACT OTHER EMMERSON, V FB. BARTON CO. NOT DISPOSED 06B4-CV00298 (My short analysis, Emmerson insured with Farm Bureau and suffered a theft loss of household and personal property on 6/8/2005. Emmerson submitted a proof of loss for $38,033.84. Farm Bureau agent Rodney Burk recovered $6262.99 for Emmerson. Farm Bureau denied the claim on 3/2/2006 Because Emmerson knew who the thieves were, failed to cooperate, and improperly served Pam Kruse, wife of Charles Kruse, President of Farm Bureau.)

Two years after the fire Farm Bureau still refused to pay the full claim and the Lusters were forced to file this suit on 7/26/06.) 8/30/06 BREACH OF CONTRACT WOODS, V FB. STONE CO. NOT DISPOSED 06SN-AC00437 (My short analysis, Daniel R. Woods and Jody D. Woods were insured with Farm Bureau on 1/24/2006 when they suffered a $41,336.86 fire loss. Farm Bureau paid $17,000.00 and refused to pay the remainder of $24,336.86. On 8/30/2006 Woods was forced to file this suit to collect from Farm Bureau.)
9/22/06 DECLARATORY JUDGMENT LEE, V FB. REYNOLDS CO. NOT DISPOSED 06RE-CC00021 (My short analysis, on May 19, 2003 Larry Lee and James Maize had an auto accident. Maize was at fault. Farm Bureau through an affiliated insurance company insured Maize's common law wife Shelly Chandler for liability. Maize and Chandler had children of their own. Farm Bureau denied the claim on grounds Maize was not a family member as defined by their policy. On September 22, 2006 Lee filed suit to force Farm Bureau to pay his claim for medical bills. On Janurary 9, 2007 Farm Bureau answered the suit with a denial of liability. On Janruary 29, 2007 Farm Bureau further answered that the most they could be liable for was the state mandated minimum amount of twenty five thousand dollars.)

Farm Bureau refused to pay Koski's claim for injuries. After four years of delay Koski files suit against Farm Bureau for non payment of claim, and for vexatious refusal to pay claim.
