PETITION - BREACH OF CONTRACT
COMES NOW Plaintiffs, Daniel R. Woods and Jody D. Woods, husband and wife, by and through their counsel, Russ Schenewerk & Associates, LLC, and for their cause of action against Defendant Farm Bureau Town & Country Insurance Company of Missouri, states and alleges the following:
I. Plaintiffs, Daniel R. Woods and Jody D. Woods, husband and wife, are residents of Branson West, Stone County, Missouri.
2. Defendant Farm Bureau Town & Country Insurance Company of Missouri is a Missouri corporation in good standing.
3. All acts and occurrences described herein took place in Stone County, Missouri and jurisdiction and venue are proper therein.
4. This lawsuit affects personal property located in Stone County, Missouri.
5. On or about January 24, 2006, Plaintiff sustained personal property damage by fire at Table Rock Lake Boat Dock (herein Boat Dock), which Plaintiff has an ownership interest.
6. At the time of the fire loss, Plaintiff was covered by an insurance policy with Defendant that provided coverage for Plaintiffs dwelling in the amount of $273,500; boat dock in the amount of $12,000; and personal property in the amount of $205,125. A copy of the insurance policy coverage is incorporated herein as Exhibit A.
7. Pursuant to Section I, COVERAGE C — PERSONA.L PROPERY, “Limitation on Personal Property Coverage” of the Protector Insurance Policy, Defendant agrees to “pay up to a maximum 10% of the amount of insurance shown under Coverage C in the Information Page(s).” A copy said section is incorporated herein as Exhibit B.
8. Due to the fire, Plaintiffs sustained damages exceeding $12,000 for the Boat Dock and damages in excess of $29,336.86 for personal property located on the Boat Dock, totaling more than $41,336.86. An itemized list of personal property items and an estimate of the boat lift(s) damages are incorporated herein as Exhibit C.
9. Defendant paid Plaintiff a total of $17,000 to cover the loss of the boat dock and the personal property lost due to fire; however, Defendant has failed and/or refuses to cover the remaining loss of $24,336.86, despite demand having been made by Plaintiffs counsel.
10. Defendant is in breach of the terms of the Agreement.
11. Plaintiffs have complied with all of their obligations under the tenns of the Agreement.
12. Despite demand having been made, Defendant has failed and refused to cover the remaining loss of property sustained by the fire.
13. Plaintiffs are entitled to interest at the statutory rate of nine percent to Section
408.020, R.S.Mo.
WHEREFORE, Plaintiff prays that his Court enter its judgment in favor of Plaintiffs and against Defendant in the monetary amount of $24,336.86, plus interest at the rate of nine percent, plus Plaintiffs costs incurred herein, Plaintiffs’ reasonable attorney’s fees, and -for such other and further relief as this Court deems necessary and proper under the circumstances.

ANSWER
COMES NOW Defendant Farm Bureau Town & Country Insurance Company of Missouri, by and through counsel, and for its Answer to Plaintiffs’ Petition, admits, denies and avers as follows:
1. Defendant is without sufficient knowledge or information to form a belief as to the truth or falsity of the allegations contained in Paragraph 1, and therefore denies the same.
2. Defendant admits the allegations contained in Paragraph 2.
3. Defendant denies the allegations contained in Paragraph 3.
4. Defendant denies the allegations contained in Paragraph 4.
5. Defendant admits that on or about January 24, 2006 a fire occurred at a boat dock in Stone County, Missouri in which Plaintiffs own slips, but denies the remaining allegations of Paragraph 5.
6. Defendant admits that on or about January 24, 2006 Plaintiffs had a policy of insurance with Defendant that provided coverage, subject to the terms and limitations of the policy, for Plaintiffs dwelling in the amount of $273,500.00, for other structures in
the amount of $12,000.00 and for personal property in the amount of $205,125.00 with a $100000 deductible. Defendant denies the remaining allegations of Paragraph 6.
7. Defendant admits that the policy of insurance issued to Plaintiffs is the contract between the parties and it states the terms and conditions of that contract, but denies the remaining allegations of Paragraph 7.
8. Defendant is without sufficient knowledge or information to form a belief as to the truth or falsity of the allegations contained in Paragraph 8, and therefore denies the same.
9. Defendant admits that it paid Plaintiffs all sums that were due and owing to Plaintiffs under the terms of the policy of insurance issued to Plaintiffs by Defendant and denies the remaining allegations of Paragraph 9.
10. Defendant denies the allegations contained in Paragraph 10.
11. Defendant admits that Plaintiffs have complied with all requests made of Defendant, but denies the remaining allegations of Paragraph 11.
12. Defendant admits that Plaintiffs have demanded that Defendant pay additional sums under the policy. However, Defendant has no obligation to do so. Defendant denies the remaining allegations of Paragraph 12.
13. Defendant denies the allegations contained in Paragraph 13.
WHEREFORE having fully answered Plaintiffs’ Petition, Defendant prays to be discharged therefrom, together with its costs herein expended and incurred and for such oilier relief as the court deems just in the premises.
AFFIRMATIVE DEFENSES
1. Further answering as an affirmative defense, Defendant states that venue is improper in the Circuit Court of Stone County, Missouri in that this is a breech of contract action and the Defendant is corporate resident of the state of Missouri with its principle place of business being in Cole County, Missouri and its registered agent being located in Cole County, Missouri and service of process was obtained upon Defendant in Cole County, Missouri. Therefore, under Section 508010, venue belongs in the Circuit Court of Cole County, Missouri.
2. Further answering as an affirmative defense, Defendant states that pursuant to the provisions of the policy issued to Plaintiffs, Defendant’s coverage for other structures is limited to $12,000 for all damage to the boat dock and the fixtures attached thereto, including but not limited to boat lifts,
3. Further answering as an affirmative defense, Defendant states that pursuant to the provisions of its policy issued to Plaintiffs, Defendant’s coverage is limited with regard to personal property, including but not limited to the following provisions of the policy:
LIMITATIONS ON PERSONAL PROPERTY COVERAGE
‘These limitations do not increase the amount of insurance for Coverage
C. Each limit below is the total limit per occurrence for all property in that category:
1. For personal property away from the residence premises, we will pay up to a maximum 10% of the amount of insurance shown under Coverage C in the information Page(s). This limitation does not apply to personal property in a newly acquired principal residence for the thirty (30) days immediately after you begin to move property there.
5. $1,000 on water craft, including their trailers, equipment, accessories and outboard motor(s).”
4. Further answering as an affirmative defense, Defendant states that other provisions of the policy limit or prohibit additional recovery by Plaintiffs in this matter.
