FARM BUREAU'S RECENT LAWSUITS WITH THEIR OWN MEMBERS 
 
(There are many, 251 in all.  I will get copies of the actual petitions of only the cases similar to mine, they show details and patterns of Farm Bureaus deceptive tactics.  It shows how they forced settlement after years of delay and financial burden on the policyholders. And always for pennies on the dollar. Of the 251 Missouri suits less than 10 went to jury trial.  I will make a short analysis of only the cases similar to mine.)

8/15/03 BREACH OF CONTRACT BARTON, VS FB. HOWARD CO.
SETTLED 3/26/04 03CV177019-01 (My short annalysis, The Bartons insured with farm Bureau and  lost their home to a fire on 5/1/03.  On 5/14/03 the Bartons delivered a proof of loss to Farm Bureau for the house and contents.  On 5/29/03 farm Bureau returned the proof of loss claiming it was incomplete or deficient.  On 5/30/03 the Bartons returned the proof of loss to Farm Bureau explaining all their records were lost in the fire and that was the best they could provide.  On 6/16/03 The Bartons hired an attorney who made demand to Farm Bureau that they pay the claim.  On 6/18/03 Farm Bureau had already retained their law firm Brown and James who through Robert Brady starts the same old delay tactics they use so often, and so successfully.  Robert Brady's letter is available on the other fb lawsuits barton page.  This letter is a good example of Farm Bureaus willingness to unfairly use minor technical aspects of the policy language to delay and deny the claim.  The list of documents Farm Bureau demanded the Bartons provide is also a good example of how "Farm Bureau does not treat each and every client as if they were their only one" as they state in their advertizing.  On 8/4/03 Farm Bureau filed an answer to the Bartons Petition which is a mirror image of the letter by Bob Brady, no substance, just intimidation, confusion, and delay.  Farm Bureaus usual tactics. On 3/25/04,  ten months after the fire the Bartons accept settlement.  It appears that by the Bartons retaining an attorney early they did not suffer four or five years of Farm Bureaus typical delay tactics. However, I do not know how much less Farm Bureau forced them to settle for than they deserved.)


8/27/03 PROPERTY DAMAGE FB. VS WESTLAKE, BOONE CO.
DEFAULT 3/2/04 03CV167912 (My short analysis, Virgil Koch insured with Farm Bureau.  On 10/3/2001 Westlake pulled out in front of Koch causing damage of $2,868.65  to Kochs car.   In this case Farm Bureau paid the claim to Koch before 8/27/2003.  Looks like Farm Bureau may have delayed paying Koch for a year and ten months. Then on 3/2/2004, seven months later filed suit against Westlake who caused the wreck to recoup the loss paid to their insured.)

11/6/03 OTHER TORT BLAKEMAN, VS FB. JACKSON CO.
JURY VERDICT FOR PLAINTIFF 6/8/05 03CV230702  (My short analysis, Blakemans truck was
stolen and burned. Farm Bureau denied claim and accused Blakeman of burning it himself. Jury decided
Blakeman had nothing to do with it and Farm Bureau should pay the claim plus damages. Farm Bureau
appeals and Blakeman, desperate after 3 years delay, and facing 2 more in Farm Bureaus appeal accepts Farm
 Bureaus settlement offer.)

1/13/04 DECLARATORY JUDGMENT FB. V BOOSE, CLAY CO.
SETTLED 4/26/06 7CV104000303 (My short analysis, Richard Boose insured with Farm Bureau and suffered a tornado loss to his home on 5/4/2003. Two months later on 7/14/2003 Boose filed a proof of loss for $267,475.00 to Farm Bureau.  On 1/13/2004 after delaying for six months, Farm Bureau filed this Declatory Judgment suit denying the claim. Farm Bureau used the exact accusations, word for word, on Boose that they used on us.  At this same time Farm Bureau ask the court to delay serving the summons to Boose. "was this suit being used as a pressure tactic to force a low settlement on Boose?."  No further action was presented on the suit. The Judge dismissed the suit on 4/26/06. No reference to what Farm Bureau forced Boose to settle for.)

2/6/04 DECLARATORY JUDGMENT FB.V FRIEDLEY, JACKSON CO.
SETTLED  8/3/04 04CV203509
(My short analysis, the Friedleys suffered a fire loss
on 7/22/02 Which Farm Bureau paid. Then had a second fire on 10/19/02, for which Farm Bureau denied
payment. On 2/4/04 farm Bureau filed a declaratory judgment suit against friedley. Case was then settled
on 8/3/04. With-out more information I have no more on this case.)

3/20/04 DECLARATORY JUDGMENT FB. V MURPHY,  JACKSON CO.
SETTLED 1/6/06 04CV208515 (My short analysis, on 6/9/2003 Murphy bought an insurance policy from Farm Bureau.  A fire occured on 6/25/2003.  Murphy filed a claim with Farm Bureau on 9/2/2003 for $213,336.49.  On 3/20/2004, six months later, Farm Bureau filed suit against Murphy denying coverage because of Concealment, Fraud, or Misrepresentations in their application.  Farm Bureaus lawyers on 1/18/05 after delaying another ten months files a deposition notice to depose Murphy.  After four more months delay on 5/27/05 Farm Bureau files for an additional three months delay.  Six months later on 1/6/2006 Farm Bureau files for a dismissal with Murphy.  Nothing in public record refering to settlement terms or amounts.  This is yet another example of Farm Bureau denying a claim, delaying payment of claim for years, sueing the insured, then dismissing the suit with-out going to court and proving their accusations)

4/9/04 BREACH OF CONTRACT SUMMERS, V FB. CHRISTIAN CO.
SETTLED 12/3/04 04CT-CV00354 (My short analysis, Janet Summers was insured with Farm Bureau and suffered a fire loss on Oct. 9, 2003. Farm Bureau paid the bank the amount Summers owed them, But refused to pay summers the rest of the claim. On April 9, 2004 Summers filed suit to force Farm Bureau to pay her part of the claim. Farm Bureau claimed they had canceled the policy before the fire. So why would they pay the bank and not Summers. Could it be Bob Brady and Brown and James saw a claim that could be delayed and denied, forcing a lower settlement for Farm Bureau to pay. If I find any settlement documents I will post them on this page. I could be wrong in my assumption, if so I will post a correction.) 

5/17/04 PROPERTY DAMAGE RARDON, V FB. RAY CO.
SETTLED  5/25/06 04CV103594 (My short analysis, Rardons had a water and mold 
damage loss on 5/11/03. They submitted a proof of loss to Farm Bureau on 9/22/03.
Farm Bureau denied payment and delayed claim until 5/17/04 when Rardons filed suit to
force Farm Bureau to honor claim. On 7/15/04 Farm Bureau sued Rardons for declaratory
judgment, which is asking the court to declare the policy void.  Farm Bureau delayed claim
until 5/25/06 when Rardons accepted Farm Bureaus settlement.)   (Eugene Parton stated in open
court on 2/20/07 while testifying in my case that Farm Bureau had secretely tape recorded Rardon
during the investigation of his claim.) 
 
5/18/04 BREACH OF CONTRACT FRISBIE, V FB. JACKSON CO.
SETTLED  6/14/05 04CV213909  (My short analysis, Kevin Frisbie insured with Farm Bureau, his 
house burned on 4/15/03. After over a year of Farm Bureau's delaying tactics Frisbie filed suit to force them to pay. Here comes 
Brown and James' Robert Brady following "the books directions" with denials and accusations  against the policyholder.  Leading to the inevitable forced settlement at a great savings to Farm Bureau.  And of course a tidy fee for  Brown and James at the cost of the policyholder.)
 
6/14/04 DECLARATORY JUDGMENT FB.V DALTON, ST. FRANCOIS CO.
NOT DISPOSED 04CV612899 (My short analysis, The Daltons house and contents were destroyed in a fire on 12/15/2003. The Daltons filed a claim for $115,000.00.  Farm Bureau denied as usual and on 6/14/2004 sued the Daltons for their usual thing, concealment, fraud,  misrepresentaion, and for inflating their losses. On 8/13/2004 the Daltons countersued Farm Bureau for Breach of contract.)
 

9/22/04 DECLARATORY JUDGMENT FB.V STADE, DAVIES CO. 43V030400079  SETTLED 11/7/06    
  ( My short annalysis, another forced settlement on 11/7/06 after a delay of over 2 years. Just another typical case for Farm Bureau and Robert Brady. False accusations not proven in court but good tactics to force a lesser settlement. I don't know yet, but I bet Farm Bureaus area supervisor Gene Parton is in on this case too.)
 
9/23/04 FARM BUREAU V GASH LAFAYETTE CO  DEC, JUDGMENT 04LF-CV00734  DISMISSED 2/14/07
(My short analysis, Gash insured with Farm Bureau and had a fire loss on 7/9/03. Farm Bureau delayed one year and two months then sued Gash on 9/23/04. Farm Bureau delayed another year and Gash sued Farm Bureau on 10/19/05. More delay until
2/14/07, over three years after the fire when Gash accepts Farm Bureaus settlement offer of  less than half of the claim amount.)
 
10/12/04 BREACH OF CONTRACT WIMBERLY, V FB. LAFAYETTE CO.
SETTLED 10/20/05 04LF-CV00820 (My short analysis, The Wimberlys suffered water damage loss on 2/3/04
. Farm Bureau in concert with Robert Brady and Brown and James, denied coverage.  After eight months delay the Wimberlys sued on 10/12/04. In Farm Bureaus answer they claimed because the water leaked from pipes under the house, then traveled through the earth before entering the house Farm Bureau was not liable. After one more year of  delay the Wimberlys accepted Farm Bureaus settlement offer and the case never went to trial.  Once again Farm Bureau did not have to prove their case.  And I have found no public records of the settlement amount.)
11/3/2004 OTHER TORT DAVIDSON V FB.  MILLER CO.  26VO50400534   SETTLED 1/24/07
(My short analysis, Cody and conda Davidson insured their house with Farm Bureau on 2/16/2003.  Then on 5/6/03 their roof was damaged by a hail storm.  On 4/21/04  Davidsons sold the house.  On 5/5/2004 The damage was discovered by the new owners.  Doing the fair thing, the Davidsons replaced the roof and turned in a claim to Farm Bureau for $11,500.00. On 5/14/04 Farm Bureau denied coverage.  This suit was filed on 10/29/04.  Here Farm Bureau and their lawyers start the fight by using the fine print and deceptive tactics they are such experts at. On 1/24/07 two and one half years later the Bad claim practices Farm Bureau so often use paid off for them when the Davidson settle.  
 
12/21/04 BREACH OF CONTRACT THERON TOMPKINS, V FB. WAYNE CO. 04CV836897 SETTLED 10/28/08 
 (My short analysis, Tompkins home was damaged in excess of $100,000.00 by an earthquake on 4/21/2004.  Farm Bureau denied the claim on 11/19/2004.  Farm Bureau claims the damage was from wear and tear, deterioration, settling, cracking, bulging, and inherent vise.)   Trial date set for 11/03/2008 , 09:00:00 - Jury Trial . Case settled on 10/28/2008, two weeks before trial. Another one Farm Bureau did not have face a jury with.
 
1/12/05 BREACH OF CONTRACT O’HARE, VS FB. ST LOUIS CHG VENUE 2/23/04  2105CC-00155  CONSOLIDATED (My short analysis, in November of 2000 Farm Bureau sold O'Hare a $500,000.00 life insurance policy. On 6/2/2003 O'Hare passed away.  On 8/29/2003 Farm Bureau denied the claim. (no surprise).  On 1/12/2005 this suit was filed.)

1/24/05 BREACH OF CONTRACT DRIVER, V FB. CHRISTIAN CO.
SETTLED 1/31/06 05CT-CV00085  (My short analysis, Lynn Driver insured with Farm Bureau and had a fire loss on May 17, 2003. Drivers Farm Bureau agent, Kevin Cheffey mistakenly under insured Drivers property. Farm Bureau refused to correct agent Cheffeys mistaken calculations on the value of Drivers home.  On Jan. 24, 2005 after over two years of delay Driver sues Farm Bureau to force payment of the claim.  On March 4, 2005 Farm Bureau answers Drivers suit. On Jan. 31, 2006 another Farm Bureau policy holder is forced to settle after nearly three years of delay.)
 
 
2/25/05 OTHER ACTIONS CHARLEY, V FB PLATTE CO 05AE-CV00606 SETTLED  07/31/2009 (My short analysis, the Charleys were under insured at the direction of  Farm Bureau agent Chad Wright in 1997.  On June 29, 2001 when their home was destroyed by fire the  amount of under insurence was discovered. Farm Bureau paid part of the claim but refused to correct the under insurance amount. Farm Bureau adjuster Debra Griffin misled the Charleys about debris removal cost. Farm Bureau denied any further payment to the Charleys who brought this suit to collect payment of their claim on  Feb. 25, 2005.) (This claim has gone on six years with no end in site.)

5/27/2005 BREACH OF CONTRACT YOUNG V FB CASS CO. CV405-382CC SETTLED 6/25/2006  (My short analysis,  the Youngs insured their home and contents with Farm Bureau on 8/24/2004. They lost it all on 12/22/2004 and filed a claim with Farm Bureau for $371,000.00 which as usual was denied.  After 18 months of Farm Bureau and Brown and James delays manipulated by Robert Brady and Eugene Parton the Youngs settled for an undisclosed amount.) 
 
6/13/2005 BREACH OF CONTRACT TERRY V FB JOHNSON CO  05JO-CV00036  SETTLED 6/20/06 (My short analysis, on 8/9/2002 Shirley Terry, while insured by Farm Bureau suffered injuries in an auto accident with Steven Bell. Farm Bureau refused to settle on 8/30/2002 or anytime thereafter. The Terrys brought this suit on 5/27/2005.  Farm Bureau delayed this case four years).  
 
8/1/05 APPEAL WD. BLAKEMAN, V FB. VERDICT AGAINST FARM BUREAU 9/7/05 WD65784 (My short analysis, after winning in court Blakeman settled with Farm Bureau when faced with additional years of delay in an appeal process orchestrated by Farm Bureau and their Brown and James law firm.  This is one of the few cases Farm Bureau let go to court without a settlement, and they lost to the jury but still won using the appeal process and more delay against the policyholder.)

8/2/05 BREACH OF CONTRACT JBS PROP, V FB. JACKSON CO.
SETTLED W/P 5/15/06 0516-CV20743 (My short analysis, JBS Properties had a water damage loss on 4/14/2004. On 5/20/2004 Regency Restoration estimated repairs at $40,094.28. Farm Bureau paid half of Regency Restoration's estimate.  In early July Farm Bureau presented JBS with a full and complete release to sign stating that the balance of the repair estimate would not be paid until it was signed.  On 7/8/2004 JBS signed the release to get the final repairs finished and 
paid stipulating that rental loss would be due on completion of the repairs.  Farm Bureau refused to pay the JBS claim and on 8/2/2005 JBS was forced to file suit against Farm Bureau To recover losses. Farm Bureaus delay of over a year in paying the claim resulted in JBS being forced to accept Farm Bureaus settlement. Farm Bureau knows these forced settlements save them from having to prove their unfair and trumped up accusations they use in their lawsuits. Farm Bureau and their Law Firm Brown and James know just how to manipulate the courts and policyholders to force these settlements.  My analysis of Farm Bureau claims denied and lawsuits with policyholders shows that their accusations used in the lawsuits are never proven because I have yet to analylize one case where Farm Bureau won a suit.  In fact I've only found one case that went to trial and they lost it.)

8/25/05 BREACH OF CONTRACT WEAVER, V FB. ST. CLAIR CO.
SETTLED 4/25/06 05SR-CC00045 (My short analysis, Rick Weaver was insured by Farm Bureau on 9/18/2003 when his home and contents were destroyed by fire. On 3/10/2004 Farm Bureau denied Weavers fire loss claim in the amount of $100,000.00. Two years later on 8/25/2005 Weaver filed this suit to force Farm Bureau to honor the policy.  On 10/7/2005 Farm Bureau rolls out their giant law firm once again with their boxing gloves on. They once again accuse the policy holder of burning his own home, intentionally concealing facts, refusing to cooperate, refusing to provide documents, and for concealment, fraud and misrepresentation.  If this case goes as the 167 other Farm Bureau cases with their members, none of these accusations will be proven in court. The policyholder will be forced by the long delay to accept Farm Bureaus low settlement offer.)
 
8/26/05 OTHER TORT FISK, V FB. JACKSON CO. SETTLED W/P 4/12/06 0516-CV23727 (My short analysis, Robert Fisk bought auto insurance from Farm Bureau and while driving it caught on fire and was destroyed. Farm Bureau delayed paying the claim for 15 months when Fisk sued to force Farm Bureau to pay Farm Bureau accused Fisk of burning his own truck and denied the claim.  after the typical Farm Bureau tactic of  long delays Fisk was forced to settle as so many are. I have found no case yet where Farm bureaus accusations against their policyholders held up in court.  They make the accusation, then settle before having to prove it in court.)                        
 
10/20/05  PROPERTY DAMAGE YOUNG, V FB. CASS CO. 05CA-CV1686 SETTLED 6/25/06 (My short analysis,  the Youngs insured their home and contents with Farm Bureau on 8/24/2004. They lost it all on 12/22/2004 and filed a claim with Farm Bureau for $371,000.00 which as usual was denied.  After 18 months of Farm Bureau and Brown and James delays manipulated by Robert Brady and Eugene Parton the Youngs settled for an undisclosed amount.)
  
12/1/05  05AK-CV00076  OTHER CONTRACT KAREN SANDERS V FARM BUREAU
BUTLER CO. SETTLED 7/31/06 (My short analysis, Karen Sanders insured her automobile with Farm Bureau.  Her car was in an accident on 10/18/2004 and was totaled.  Farm Bureau denied her claim and on 12/1/2005 Sanders filed suit to force Farm Bureau to pay the claim.  On 2/28/2006 Farm Bureau filed their answer to Sanders suit. The case never came to trial, and was settled on 7/31/2006 With no public record of the settlement terms.)
 
1/26/06 AC SUIT DILLON V FB. CLAY CO. SETTLED 8/31/06 7CV106000784  (My short analysis, Christine Dillon insured with Farm Bureau and had a theift loss of $8500.00 on 12/19/2000. On 1/26/2006 Dillon files suit against Farm Bureau for not paying the claim. On 7/6/2006 Farm Bureau filed their answer denying liability because the stolen property was not on the insureds premises even though the storage unit was listed as an insured location in the policy.  Did Robert Brady and the Brown and James law firm save Farm Bureau a lot of money on this forced settlement? This is the longest Farm Bureau delay I have seen, six years.)   
 
6/22/06 CONTRACT OTHER EMMERSON, V FB. BARTON CO. 06B4-CV00298  SETTLED 6/18/08 (My short analysis, Emmerson insured with Farm Bureau and suffered a theft loss of household and personal property on 6/8/2005. Emmerson submitted a proof of loss for $38,033.84. Farm Bureau agent Rodney Burk recovered $6262.99 for Emmerson.  Farm Bureau denied the claim on 3/2/2006 Because Emmerson knew who the thieves were, failed to cooperate, and  improperly served Pam Kruse, wife of Charles Kruse, President of Farm Bureau.)  
 
6/27/06 BRE OF CON HOBICK V FB. JACKSON CO. 0616-CV15984    SETTLED 10/11/07
(My short analysis, the Hobicks had wind and hail damage on 5/15/05. Eleven months later on 6/27/06 they sued Farm Bureau for payment.  On 9/12/06 Farm Bureau answerd  with a denial of any liability. They seem to be claiming that  the Hobicks caused the damage themselves because of some failure to mitigate the storm damages. Dismissed with undisclosed settlement amount on 10/11/07. This shows the character of the insurance company in that they would even consider denying the claim because of such a technical clause in the policy. They are certainly not following their own policy of treating every insurance policyholder as if it were their only one.) Here is what they promise in their claims philisopy.  "Approaching every claim as an opportunity to treat the insured as if their claim is the only one we have, realizing that if we don't take care of our customers someone else will gladly do so". I don't think they lived up to that promise with any of the 167 policyholders forced into lawsuits with them since 2003. 

7/26/06 CONTRACT OTHER LUSTER, V FB. ST. LOUIS CO. 0622-CC05287 CHG OF VENUE
(My short analysis, Stanley and Carolyn Luster insured with Farm Bureau and had a partial loss of their house by fire on 4/26/04. They submitted their proof of loss on 8/12/04 for $95,000.00. Farm Bureau paid $42,143.68 on 6/23/05.  Two years after the fire Farm Bureau still refused to pay the full claim and the Lusters were forced to file this suit on 7/26/06.)
 
8/18/06 - ROSS R POOL V FARM BUREAU  BRE OF CON PHELPS CO. 25V03061151C   TRIED  01/22/2009 VERDICT FOR FARM BUREAU (Change of venue from Pulaski Co.)  (My short analysis, This case is another long one, Farm Bureau has delayed this case longer than mine. The Pools had water damage loss on 2/10/03. By 2/23/04 Farm Bureau started repairs. On 3/12/04 repair work stopped.  On 11/17/05 the Pools sued Farm Bureau for failing to repair and pay for the damages.  On 2/27/06 Farm Bureau answered the Pools lawsuit. It's hard to believe but the trial date is set for 3/4/08.) 
 
8/30/06 BREACH OF CONTRACT WOODS, V FB. STONE CO. 06SN-AC00437 TRIED BY COURT, VERDICT AGAINST FARM BUREAU ON 8/7/08. (My short analysis, Daniel R. Woods and Jody D. Woods were insured with Farm Bureau on 1/24/2006 when they suffered a $41,336.86 fire loss.  Farm Bureau paid $17,000.00 and refused to pay the remainder of $24,336.86.  On 8/30/2006 Woods was forced to file this suit to collect from Farm Bureau.)This shows that Farm Bureau can be beaten at their deceptive and unfair claims tactics if the policyholder can hold out through all of their delays. This also shows that Farm Bureau denies all these claims without any real legal reason, counting on beating down the policyholders to settle befor Farm Bureau has to prove their false accusations in court.

9/22/06 DECLARATORY JUDGMENT LEE, V FB. REYNOLDS CO.  06RE-CC00021 SETTLED 8/27/07 (My short analysis, on May 19, 2003 Larry Lee and James Maize had an auto accident.  Maize was at fault.  Farm Bureau through an affiliated insurance company insured Maize's common law wife Shelly Chandler for liability.  Maize and Chandler had children of their own.  Farm Bureau denied the claim on grounds Maize was not a family member as defined by their policy. On September 22, 2006 Lee filed suit to force Farm Bureau to pay his claim for medical bills.  On Janurary 9, 2007 Farm Bureau answered the suit with a denial of liability. On Janruary 29, 2007 Farm Bureau further answered that the most they could be liable for was the state mandated minimum amount of twenty five thousand dollars. JACKSON CO. 0616-CV26661 SETTLED 9/4/07  (My short analysis, Koski was insured by Farm Bureau and was in an auto accident with Juli Chapman on 10/12/02. Farm Bureau refused to pay Koski's claim for injuries. After four years of delay Koski files suit against Farm Bureau for non payment of claim, and for vexatious refusal to pay claim.  This means Farm Bureau intentionally and with malice refused to pay the claim. Will Farm Bureau and their law firm  force a settlement on Koski?,  we'll see.  Yes, on 9/4/07.)

NOT DISPOSED (My short analysis,  On 12/15/2000 Farm Bureau agent Jeff Carr issued insurance binder for house under construction.  On 12/28/2006 Allsbury files suit against Farm Bureau because Farm Bureau denied the insurance policy was ever issued. The claim is now scheduled for mediation on or before 9/15/2007, I will keep tabs on this case and add more later.)

0611-CV08096  SETTLED ON 12/17/07 (My short analysis, on 2/25/05 Butler was rear ended in an auto accident. His damages exceeded the other drivers insurance coverage.  Butler had underinsured motorist coverage with Farm Bureau and sued for the difference.  Farm Bureau denied that the other driver was underinsured even though it was not enough to cover the damages. I will watch how this turns out.)   (Like all the others is was settled before trial.)

order. This time against one of their own agents.  On the Daily Updates page on 3/6/07 I made note of
the fact that all the present Farm Bureau agents seem to be very young. I wonder if there are more
ex Farm Bureau agents in Mr. Sheets predicament. I'll keep watching this case.)

in these 2 suits is whether it is an ongoing policy at Farm Bureau to replace the older more experienced agents who would be
less likely to tolerate Farm Bureaus apparent policy since at least 2003, of litigating  these 167 policyholders suits. I'm sure Farm Bureau would say it's to save money on commissions and benefits. But the reality may be different.)

If Farm Bureau is successful in this suit they will not be out any money on the Dierks claim. which is perfectly legal and proper.)

(My short analysis, Phil N. Christophers Mother Joyce C. Christopher insured with Farm Bureau.  On 8/29/2006  Phil had a wreck and his passenger Bernard Price was injured.  The vehicle was owned by Bernards parents, Ben and Gloria Price. Farm Bureau denied coverage with their usual lies as a reason.  They claim Phil was not an insured even though he was Joyce Christophers son living in her home.  They claim he owned a vehicle of his own and that fact made him not an insured person, even though the policy states he was an insured.)  
 
7/30/07 FB V JAMES SWAIN SCOTT CO. DECLARATORY JUDGMENT 07SO-CV01767 DISMISSED 1/22/09          (My short analysis, Farm Bureau has denied James swain's insurance claim. They claim his policy expired approximatley 2 hours before the accident.  In my case Farm Bureau notified me when my policy was expired and allowed me 10 days to reinstate.  Until Swain answers this suit I will not speculate on it.)
 
09/12/07 - FB  V TOM EVANS ST. CHARLES CO  0711-CV07188 PROP DAMAGE SETTLED ON 1/14/09 (My short analysis,  Joshua Stone insured his car with Farm Bureau.  On 2/4/2004, Mr. Stone, while driving his car hit a horse owned by Tom Evans.  This caused $8200.00 damage to his car.  At some undisclosed point during the three years between the accident and filing of this suit, Farm Bureau paid Joshua Stone for his damages. On 9/12/07 Farm Bureau sues Tom Evans to recover what they paid out to their insured.  Hopefully,  Mr. Stone didn't have to wait three years for his claim to be paid.

10/31/07 NEWBERRY V FB  BREACH OF CON  07CM-CC00390  CAMDEN CO.  THIS CASE DISMISSED OUT OF COURT ON 1/26/2009 AFTER THREE YEARS DELAY FROM FARM BUREAU AND THEIR LAWYERS.
(My short analysis, The Newberrys insured their boat with Farm Bureau on 8/5/06.  On 12/2/06 the boat was damaged in an ice storm. Farm Bureau refused to pay the claim.  The suit alleges that Farm Bureau used false estimates of the boats salvage value.  In my claim they also used a false letter, and sent it to the Mo. dept of Insurance to help defeat our claim.  This shows they will stop at nothing in their deceptive, currupt, claims denial tactics. Then on 10/31/07 this suit was filed.  The Rattlesnake has struck again.)

 (My short analysis, Michael and Tammy Countryman are an unfortunate couple who accidentally caused a fire in their rented home.  They are unfortunate because  if this house had been insured by any other company they surley would  have paid the claim and moved on.  But not Farm Bureau, and I blame this on Brown and James as much as Farm Bureau.  After all this Robert Cockerham, Farm Bureaus lawyer, is the man who wrote the book on how to sue policyholders and cheat them out of their claims.  And he works for Farm Bureau.  This is one case where Farm Bureau could have stepped forward on their own and treated these people fair, but no, they are following these greedy lawyers at Brown and James right down the river.  Or maybe Farm Bureau is leading them, it's hard to tell.  If Farm Bureau has their way, and they usually do this couple will end up with a $30,000.00 judgment over their heads.  All over forgetting to take the pot off the stove.  And they didn't even buy insurance from Farm Bureau. (Farm Bureau didn't have their way this time.)

(My short annalysis, Cheryl Jensen trusted Farm Bureau enough to buy a homeowners policy from them.  On 9/23/2006 Cheryl Jensen suffered a loss to her property from a house fire. She had always kept her policy payments paid to farm Bureau.  After eight months of delay by Farm Bureau they denied her claim on 5/10/2007.  In an attempt to collect on her Farm Bureau policy Cheryl Jensen was forced to file this suit on 1/18/2008. Farm Bureau in this case used their often used tactic of accusing the policyholder of misrepresentation of the personal property loss items and amounts)
 
4/21/08 BRET MERSEAL V FB BREACH OF CONTRACT ST. FRANCOIS CO. 08SF-CC00444 NOT DISPOSED
(My short analysis, Bert and Glenda Merseal became members, and bought homeowners insurance from Farm Bureau for their home in Bonne Terre Mo. and on April 7, 2006 an accidental fire totally destroyed the dwelling.  Farm Bureaus' Town and Country Insurance denied the claim, then delayed two more years until June 16, 2008 when the Merseals filed this suit to force Farm Bureau to pay the claim.  Farm Bureau admitted that they insured the home, and that It was destroyed by an accidental fire.  Then Farm Bureau put their giant law firm, Brown and James on the case.  The lawyer assigned was Bob Brady, who has handled over 40 claim denial cases for Farm Bureau in recent years. Farm Bureau uses these tactics to keep from paying claims. Bob Brady used their often used unfair tactic of accusing the policyholder of intentionally misrepresenting the extent of their loss. He uses this tactic with the full knowlege of Farm Bureau.  Farm Bureau knows they will never have to prove their accusations in court because they always delay these claims so long that the member has to accept their lowball settlement offer because of financial burdens following a fire loss. That lowball settlement offer always comes before a trial.  Farm Bureaus' tactics come directly from the McKinsey Slides playbook to Insurance companies on how to beat policyholders out of their claims.  Charles Kruse, President of Farm Bureau, and all the directors should study this claim, and then do something to stop this continued abuse of Farm Bureau members. I challenge each Farm Bureau Director to study this claim and decide what they would do if it was one of their own family members or a close friend being treated this way by Farm Bureau. I don't challenge Charles Kruse because I know he doesn't care. )

(My short annalysis, on Jan. 23 2008, Farm Bureau agreed to settle his case for $70,000.00.  Then on May 8, 2008 Farm Bureau notified Austin White that they were backing out of the settlement agreement.  White hired an attorney who took legal action which forced Farm Bureau to honor the original agreement.)

5/20/08 TROY MEYERS V FB BREACH OF CONTRACT, MALICIOUS PROSECUTION, DEFAMATION OF CHARACTER, HOWELL CO. 08AL-CV00070  JURY TRIAL 10/7/09 VERDICT AGAINST FARM BUREAU (My short analysis, On Oct. 26, 2006 Troy Meyers paid $555.23 to Farm Bureau to insure his home for $48,375.00.  On May 30th. 2007 his home burned. Farm Bureau denied the claim as they so often do.  After a year of delay caused by Farm Bureau Meyers is forced to file this suit to make them  pay his claim.  During this year Farm Bureau used their vicious tactics on him similar to what they did to Mr. Blakeman from Richmond Mo. in 2003. That case was "Blakeman vs FB Jackson Co. Mo. 03CV230702".  In that case Blakemans truck was
stolen and burned. Farm Bureau denied the claim and accused Blakeman of burning it himself. But the Jury decided
Blakeman had nothing to do with it and Farm Bureau should pay the claim plus damages.  Lets hope Meyers' case has the same outcome.  I'm sure it will because this is typical of Farm Bureau to do anything to cheat a policyholder out of their claim).
 
12/31/2009  DURING THE YEAR 2009  MISSOURI FARM BUREAU WENT TO COURT WITH 74 DIFFERENT POLICYHOLDERS.  AS OF TODAY FARM BUREAU HAS 43 ACTIVE LAWSUITS ALL OVER MISSOURI. DURING THE YEAR 2009 FARM BUREAU HAS USED THE COURT SYSTEM, AND THEIR UNFAIR CLAIMS PRACTICES TO FORCE SETTLEMENTS WITH 31 POLICYHOLDERS, MOST FOR PENNIES ON THE DOLLAR. FARM BUREAU HAS STARTED THIS YEAR, 2010, WITH A SUIT FILED ON 1/5/2010 AGAINST LESTER GALBRAITH IN BUTLER COUNTY MISSOURI.  AS USUAL THEY ARE USING ROBERT BRADY AND THIER GIANT LAW FIRM BROWN AND JAMES. THE NUMBER OF CLAIMS THEY SUCCESSFULLY DENY AND SETTLE WITHOUT EVEN GOING TO COURT IS UNKOWN BY ME, BUT JUDGING FROM MY E-MAILS THERE ARE MANY. I WILL NO LONGER POST THE ACTUAL LAWSUIT DOCUMENTS BECAUSE THEY ARE ALL SO SIMILAR, AND USE THE SAME UNFAIR TACTICS THAT FARM BUREAU HAS USED IN ALL THE PREVIOUS CASES. THE CASES ARE ALL THE SAME, OVER AND OVER AND OVER.
